1. Agreement and acceptance
These Terms of Service ("Terms") govern your use of the Start 2 Load platform ("Platform"), including our website and services that connect shippers with carriers for the transport of goods. By registering, accessing, or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
2. Definitions
- Platform – The Start 2 Load website, applications, and services that facilitate matching and communication between Shippers and Carriers.
- Shipper – A user seeking to arrange transport of goods (e.g. loads, shipments).
- Carrier – A user offering transport capacity (e.g. trucks, vehicles) or transport services.
- User – Any person or entity that registers or uses the Platform, whether as Shipper, Carrier, or both.
- Services – The provision of the Platform, including listing loads or trucks, matching, messaging, and related tools.
- Goods – The items or cargo tendered for transport. This may include general cargo, perishables, or goods subject to special regulations (e.g. dangerous goods where permitted).
3. Role of the platform
Start 2 Load acts as an intermediary. We provide a platform where Shippers and Carriers can find each other, negotiate, and agree on transport. The contract for carriage is formed directly between the Shipper and the Carrier. We are not a carrier, freight broker, or party to any transport contract. We do not assume liability for the actual transport of goods, delays, loss, or damage to cargo, or for the conduct of Users. Use of the Platform does not create an agency, partnership, or employment relationship between you and Start 2 Load.
4. Registration and account
You must provide accurate, complete, and current information when registering. You are responsible for keeping your login details secure and for all activity under your account. You must be at least 18 years old (or the age of majority in your jurisdiction) and have the authority to bind any company you represent. We may refuse or suspend access to the Platform at our discretion.
5. Your obligations
You agree to:
- Provide accurate information when posting loads or transport offers (origin, destination, dates, weights, dimensions, trailer type, and any special requirements).
- Comply with all applicable laws, including transport, customs, and safety regulations (e.g. ADR for dangerous goods where relevant).
- Not use the Platform for illegal goods or purposes, or to circumvent fees or terms (e.g. by exchanging contact details to deal off-platform before a booking is made, if we charge for introductions).
- Not post false, misleading, or defamatory content; not harass other Users or abuse the messaging system.
- Resolve disputes with other Users in good faith. We may facilitate communication but are not obliged to resolve disputes.
6. Dangerous, restricted, and perishable goods
You must accurately declare the nature of the goods. Transport of dangerous goods, restricted items, or perishables may be subject to specific laws and carrier requirements. Carriers may refuse loads that are misdescribed or that would breach law or their operating conditions. You are solely responsible for correct classification, packaging, labelling, and documentation. We do not guarantee that the Platform or any Carrier is suitable for any particular type of goods.
7. Fees and payment
Any fees for using the Platform (e.g. subscription, listing, or success fees) will be communicated on the Platform or in separate agreements. Payment terms are as stated at the time of purchase. As between Shipper and Carrier, payment for the actual transport is agreed between them; we are not responsible for non-payment or disputes about transport fees. Refund policies for Platform fees (if any) will be stated where you sign up or pay.
8. Limitation of liability
To the fullest extent permitted by law, Start 2 Load and its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Platform or from any transport arranged via the Platform. Our total liability for any claim arising from these Terms or the Platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim (or one hundred euros (€100), whichever is greater). Some jurisdictions do not allow certain limitations; in such cases our liability will be limited to the maximum permitted by law.
9. Indemnity
You agree to indemnify and hold harmless Start 2 Load, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your breach of these Terms; (c) your violation of any law or third-party rights; or (d) any dispute between you and another User (including Shippers and Carriers) in connection with transport or the Platform.
10. Intellectual property and content
The Platform and its content (including design, text, graphics, and software) are owned by Start 2 Load or its licensors. You may not copy, modify, distribute, or create derivative works without our written permission. You grant us a non-exclusive, royalty-free licence to use, store, and display content you submit (e.g. load descriptions, messages) to operate and improve the Platform. You represent that you have the right to submit such content and that it does not infringe third-party rights.
11. Privacy
Our collection and use of personal data is described in our Privacy Policy. By using the Platform you consent to that processing.
12. Changes to the Terms and Platform
We may change these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Continued use of the Platform after changes constitutes acceptance. We may also modify or discontinue features of the Platform with reasonable notice where practicable.
13. General
These Terms constitute the entire agreement between you and Start 2 Loadregarding the Platform. If any provision is held invalid, the remainder remains in effect. Our failure to enforce any right does not waive that right. Governing law and place of jurisdiction will be the laws of the European Union member state in which we operate (e.g. Lithuania), without regard to conflict of laws principles. Any disputes shall be resolved in the courts of that jurisdiction, unless otherwise required by mandatory law.
